Letter of Authorization (LOA)
Authorization terms
When you submit the Feral Watt quote form and type your name, you sign a standard Letter of Authorization (LOA) for historical usage information on behalf of your business. It lets us see how your business actually uses power so your quote is built on real numbers. These are its terms in plain language, followed by the LOA's exact wording.
What you're authorizing
You authorize your utility (delivery company) to release energy usage data for the service address and the ESI ID(s) or utility account number(s) on your LOA. That includes kWh, kVA or kW, and interval data if your meter records it.
In Texas your utility is called the Transmission and Distribution Service Provider (TDSP): Oncor, CenterPoint Energy, AEP Texas, TNMP, Lubbock Power & Light or Nueces Electric Cooperative, depending on where your business is. We check that box on the LOA when it's clear from your service address (for example, CenterPoint Energy for an address in Houston). Otherwise we read it from your bill.
Who receives your usage data
The LOA directs the utility to release the data to Choice Power, the retail electric provider authorized to receive this information, at the request of Feral Watt, the Customer's energy broker. Feral Watt uses it to prepare your quote. The LOA names Choice Power because the utility can only release data to the party identified on the form.
Choice Power is the named party for service in Texas. For service outside Texas, this authorization applies to the supplier quoting your account instead: your utility may release your usage data to that supplier and to Feral Watt so we can prepare your quote.
How much data, and for how long
The request is limited to no more than the most recent 12 months of service. If your meter is an interval (IDR) meter, we request both summary billing data and interval data.
The LOA is dated the day you submit the form and expires 12 months later.
What you confirm
You confirm that the account is a commercial (business) account, not a residential one.
You affirm that you have the authority to make and sign this request on behalf of your company for all ESI IDs or utility account numbers associated with the request, for example as the owner, a partner or an officer.
The LOA also carries a pre-checked statement in which Choice Power affirms that it has authorization from you, the customer identified on the form, to obtain your historical usage information, and which releases the utility from all liability for providing that historical data to the party named on the form.
What goes on your LOA
From your form answers, each asked once: the date, your service address, your ESI ID(s) or utility account number(s), your typed signature, business name, your name (printed), your title or role, phone, email and billing address. Your utility (delivery company) comes from your service address, or from your bill if it isn't clear from the address. Fax number and tax ID are left blank.
It's not a contract
The LOA says so itself: this is not a contract. It doesn't change your electricity supplier, your rate or your service, and it doesn't commit you to anything. You only switch if you later sign a supplier contract.
Your electronic signature
Checking the authorization box and typing your full legal name is your electronic signature on the LOA. It has the same effect as signing on paper under the U.S. E-SIGN Act and state electronic transactions laws, including the Texas Uniform Electronic Transactions Act. Your typed name must match the name you enter at the top of the form.
With your signature we record the date and time, the IP address and browser used to submit, and the exact consent wording you agreed to, and we attach that record to your LOA. You can download your completed copy right after you submit, or ask for one anytime at hello@feralwatt.com.
Instructions to the utility (printed on the LOA)
If an attachment is used, please use a separate attachment per TDSP with the ESI IDs that are specific to that TDSP. The TDSP will reject ESI IDs that are not associated with its territory.
